Writs of Execution

Money Judgment Writ
File the praecipe and writ of execution, the writ notice, major exemption, and the claim for exemptions. With a garnishee, file interrogatories and the address of garnishee on the praecipe.

Note: To file a writ on a confession of judgment, use the praecipe upon a confessed judgment, the notice 2958.1, 2958.2, or 2958.3 as required and the petition to strike. You need the writ notice, major exemption, and claim for exemption. To file a writ of possession on a confession of judgment, file the praecipe for possession upon a confessed judgment, and the notice 2973.1, 2973.2, or 2973.3 as required, and the writ.

Mortgage Foreclosure

File the praecipe and writ with the 3129 affidavit and Act 91 certification, if applicable. Include the address or legal description of the property.

Possession
File the praecipe and writ with the address or legal description of the property.

Writ of Revival
File the praecipe and writ of revival. The money amount must be the same or less than the original judgment. Include certification of addresses.

Indexed Writ
File a time-stamped copy of the writ with a raised seal from another county with the writ notice, major exemption, and claim for exemptions. Include certification of addresses. The writ must be directed to the sheriff of Montgomery County. With a garnishee, file interrogatories with an original signature and address of garnishee.
